Right of withdrawal

Purchases made on the Site www.paolopenko.com are governed by these Terms and Conditions and the Italian law on mail order and distance selling. Pursuant to art. 64 and s.s. of D. Lgs. 206/2005 (Consumer Code), the consumer customer (ie a person who buys goods for purposes not related to his professional activity, or without indicating a reference to VAT) has the right to terminate the purchase contract for any reason and without explanation, under the conditions set out below: – the Customer must send, within 14 (fourteen) working days from the date of receipt of the goods, a communication containing the clear indication of the will to withdraw; the burden of proof of compliance with the terms is borne by the Customer, it is therefore suggested to use a registered letter with return receipt, or other equivalent form; – the substantial integrity of the returned goods is an essential condition for the exercise of the right of withdrawal; – once the integrity of the returned Product has been verified, the Company will refund the Customer the full amount paid for the Products referred to in the Purchase Agreement subject to withdrawal, no later than 14 (fourteen) days from the return of the Products. The Company will refund the entire value of the order, or part of it if the withdrawal was partial, by bank transfer, or by other means specifically agreed between the Company and the Customer. It should be noted that in accordance with current legislation, the Company will reimburse the customer only the sums paid by the latter as the price of the products. The Customer will be responsible for the expenses necessary to return the Products subject to withdrawal to the Company.

Non-conformity of products and defective products

The Products offered on the Site comply with national and Community legislation in force in Italy. The Company guarantees that the products are free from manufacturing defects. In case of non-conformity of the Products purchased with respect to the description published on the Site and in case of a defective Product, the Customer must immediately send the Product to the Company for verification. Within 8 days from the receipt of the goods, the Company will send via email its own considerations on what has been found by the Customer; if the non-conformity or defectiveness of the Product is confirmed, the Customer will be entitled only to a refund or replacement of the good. A communication will follow from the Company indicating the method of reimbursement, excluding any further liability, for any reason. Replacement or reimbursement is in any case excluded if it is ascertained that the Product has been tampered with or modified by the Customer or anyone on his behalf.
